18-month automatic extension of work permit for H-1B spouses

US Citizenship and Immigration Services (USCIS) recently announced the automatic extension period for Employment Authorisation Documents (EADs), aka work permits applicable to green card holders and spouses of H-1B visa holders. As a temporary measure, the extension period of up to 180 days will automatically be extended to up to 540 days from the expiration date stated on the current Employment Authorisation Cards (EADs), effective from May 4, 2022. This is expected to benefit the thousands of Indians across the US. 

“As USCIS works to address pending EAD caseloads, the agency has determined that the current 180-day automatic extension for employment authorization is currently insufficient,” USCIS Director Ur M. Jaddou stated. He also added that this rule however temporary will help noncitizens eligible for an automatic extension, a chance to remain employed while providing the necessary care and support for their families and steering clear of disruption for US employers. 

This temporary extension is available to eligible applicants if they filed their Form I-765 renewal application between May 4, 2022, and October 26, 2023, including these dates:

  • Before May 4, 2022, and your 180-day automatic extension has since expired;
  • Before May 4, 2022, and your 180-day automatic extension has not yet expired; or
  • Between May 4, 2022, and Oct. 26, 2023, inclusive of these dates.

Additionally, if they file a Form I-765 renewal application Beginning October 27, 2023, the normal 180-day automatic extension period will apply.
